As part of your subscription process, you must warrant in favour of The Real Thiel that you have read the Terms and Conditions and accept them.

The Services

If you apply to receive the Services and or products from The Real Thiel and The Real Thiel agrees to supply the Services and or products to you, you agree to pay all applicable fees to The Real Thiel for the Services and products in accordance with the following terms and conditions (Terms & Conditions).

Application of Terms & Conditions

These Terms & Conditions apply to the agreement for you to subscribe to The Real Thiel newsletter, email campaign marketing and or the members area (‘Knowledge Bank’) for The Real Thiel publishing, vlog, presentation and education services (the Services and products) and form a binding contractual between you and The Real Thiel. In addition to the Services and products, these Terms & Conditions also apply to any unpaid services or information available to you through The Real Thiel’s website, social media or other forums. 

Acceptance of Terms and Conditions

By watching vlogs or presentations, downloading and reading documents, or subscribing to the Services or products, or becoming a member of The Real Thiel social media community or other forums, you acknowledge and accept that your conduct evidences that you accept these Terms & Conditions as well as our Privacy Policy. By accessing the Services or products, you acknowledge you have read, understood and agree to be legally bound by the Terms & Conditions and to the collection and use of your personal information in accordance with our Privacy Policy.

If you do not agree to the terms and conditions, as amended from time to time, you are not permitted to use the Services or products or The Real Thiel website, social media or other forums.

Fees for products

Once you are a subscribed member of The Real Thiel, you will have access to certain products which you may elect to purchase from time to time. Those products must be paid upfront using a valid credit card.  As part of the subscription process you will be asked to provide your credit card or debit card details. Payments for any paid Services (which include the products) are in Australian Dollars ($AUD) only. Subscribers to the Services may make online subscription payments using credit card or debit card (Visa or MasterCard are accepted).

Privacy

The Real Thiel collects personal information to conduct special offers, provide you with the Services and promote its services and those of its sponsors and business partners. The Real Thiel may, for an indefinite period unless otherwise advised, use the information for future marketing, promotional, publicity, research and profiling purposes.  If you do not consent to the use of your information for these purposes or you wish to access, update or correct personal information please advise us in writing. 

Cookies and Links

This website uses cookies.  If you do not have cookies enabled in your web browser some functions of the site may not work as intended. Our websites and emails may contain links to websites not owned or operated by The Real Thiel.  We accept no liability for the availability or content on these sites.

Online payment security

Credit card details of subscribers are retained by Stripe the payment gateway used by The Real Thiel to process payments.  Subscribers are personally responsible for the security of their personal username and password, which gives access to personal details other than banking details (including name, address or telephone number).

Refund policy

The Real Thiel offers a 100% money back guarantee on the Services only in circumstances where you have paid for a product if the refund request is received by email on the same day of purchase of a product.   Any other refunds (in respect of cancelling a coaching session or otherwise), is at the sole discretion of The Real Thiel.

Internet

The Real Thiel is not responsible for and will bear no liability for your access to the internet.  You are only able to access the Services via the website www.therealthiel.com, using your email address and password. 

The Real Thiel is not responsible for lack of access due to changes made by third parties such as companies that produce internet browsers and/or security software.  Where we have been notified of access issues caused by third party changes we will endeavour to make any solutions available to our members and free trial members as soon as possible.

Warning acknowledgement        

You acknowledge that The Real Thiel does not give any financial services advice through the Services, social media or other forums is information or general information only and does not consider your objectives, financial situation or needs.  You also acknowledge that The Real Thiel has not considered whether the information or advice is suitable for your unique needs and circumstances and you need to consider your personal objectives, financial situation and future requirements and where there is one available, you should be carefully reading any product disclosure statement, prospectus or other offer document, before making any investment decisions or dealing in financial products.

The information provided as part of the services may indicate The Real Thiel’s present views, however, The Real Thiel’s views may change without notice and you acknowledge that you must seek advice before acting upon any recommendation and make your own enquiries before any decision to take any action as a result of the Services provided.

• your use, or reliance in any external website, including a website which is referred to by a hyperlink from the Service upon, the information;
• any failure of The Real Thiel’s systems, including information technology and business systems;
• any advice, recommendations, representations or statements made by The Real Thiel or any other party in connection with the Services, The Real Thiel social media or other forums which you relied upon; and
• any services provided by, or representations or statements or opinions by a third-party, whether the third-party was recommended by The Real Thiel.

Warrantees and acknowledgements

You acknowledge and agree that:

• the Services will not operate on a continuous basis, and may be unavailable from time to time including for maintenance purposes;
• The Real Thiel reserves the right to alter, amend or cease the operation of the Services at its discretion without any notice;
• information and materials in the Services may contain inaccuracies and errors and we expressly exclude liability for any inaccuracies or errors;
• the Services are designed to generally inform and The Real Thiel does not intend the Services to influence your decision about any investment or dealing in financial products;
• The Real Thiel is not qualified to provide, and will not provide you with, credit advice, financial product advice (in any form) and any advice provided by The Real Thiel is not intended to and does not constitute credit advice;

The laws of other jurisdictions may restrict the Services, social media and other forums so all contracts for the services may only be created in Australia and by subscribing for services you acknowledge that the contract is created in Australia.

You represent and warrant to us that you:

• are over the age of 18 and have the legal capacity to enter these terms and conditions;
• will keep all passwords, account names, and log in identifiers required to access the Services secure and confidential and if you become aware of unauthorised use you will change your password immediately and report it to The Real Thiel;
• will not use the Services in any way that causes, or is likely to cause, the Services or access to them to be interrupted, damaged or impaired in any way;
• will not use any part of the Services that you are not authorised to use or devise ways to circumvent security to access the Services;
• will not use or attempt to use the Services for any unlawful, criminal or negligent purposes – this includes, but is not limited to, breaking passwords, social engineering, denial-of-service attacks, harmful and malicious destruction of data, infringing the intellectual property rights of any person, and spreading computer viruses and invading privacy. 

Indemnity

You agree to indemnify and keep The Real Thiel indemnified against any loss, damage, liability or cost incurred by you or your associates in connection with any breach of these terms and conditions or any other legal obligation by you or your use of or conduct of the Services or social media.

Forums and Social Media    

These terms and conditions also apply to the use of any forums and social media accesses in conjunction with the Services. You acknowledge and agree that:

• The Real Thiel does not endorse the accuracy or authenticity of any posts made by other people on any forums or social media;
• posts are not made by The Real Thiel unless noted;
• The Real Thiel moderates the Forums and in its sole discretion may require posts to be approved before publication, and/or publish, not publish, modify and/or delete any posts, without notice;
• The Real Thiel, in its sole discretion, can withdraw any person’s access to a forum or social media without notice;
• you cannot offer for sale or advertise any products, services, charities or any other matters in posts on a forum or social media;
• posts in a forum or social media may not be genuine or accurate; and
• information about a post may be made available to other parties (including government regulators) at The Real Thiel’s discretion and that other party may act on the post.

You represent and warrant to us that you:

• are responsible for any post which you make on a forum or social media;
• will not engage in misleading conduct (whether by statement or omission) on a forum or social media;
• you will not make a post on a forum or social media which breaches any law, these terms or constitutes defamation;
• will disclose if you have any interest, direct or indirect, in any financial product referred to in a post and must not make any posts that rely on inside information; and
• will not insert hyperlinks to financial product advice provided by licensees or authorised representatives other than The Real Thiel.

Personal use only

The Services are only for your personal use, unless otherwise agreed in writing. You must not share access to the Services with other people or redistribute the content of the Services by any means. 

Grant of licence

The Real Thiel grants you a revocable, non-exclusive, non-transferable licence to use The Real Thiel’s Services.  This licence grant includes all new material and amended material contained in the Services to which you are entitled to by way of sign up, download, payment or subscription. If you do not comply with these terms and conditions, you may be liable for all resulting damages suffered by you, The Real Thiel and any third parties. Unless otherwise provided by these terms and conditions, you agree not to alter, reproduce, adapt, distribute, display, publish, reverse engineer or translate the content contained in the Services or otherwise attempt to create material that is derived from the content of the Services. Upon expiration or termination of the Services, this licence terminates and you agree to immediately cease all use of the Services.

Editorial break

The Real Thiel may take editorial breaks during the year during which time no new materials will be published. The Real Thiel will provide you with notice of any editorial breaks when appropriate.

The Real Thiel reserves the right to replace or update these Terms & Conditions at any time. We will provide notice of these changes by publishing our new terms and conditions on The Real Thiel website and any replacement or update will be effective immediately. You should ensure that you regularly review our terms and conditions to take note of any changes.

If there is any inconsistency between the Terms & Conditions and any other The Real Thiel documents, the current version of the Terms & Conditions prevails to the extent of the inconsistency unless it is specifically provided in writing and agreed by The Real Thiel that other terms should override the current Terms & Conditions.

Subscribers and members are expressly forbidden from claiming or making any assertion that they, whether as an individual or representative of a company, are the author of any material contained in the Services or The Real Thiel social media, or other forums.

All terms giving rights to The Real Thiel survive the Terms & Conditions.

The Real Thiel may cancel without notice the membership of any subscriber or member who breaches the Terms & Conditions. The Real Thiel’s rights are not affected by termination of the Services or membership.

The Terms & Conditions, your use of the Services, vlogs, presentations and social media and forums and any dispute arising out of these is governed by and construed in accordance with all applicable laws in force in the State of South Australia, Australia from time to time and the parties submit to the non- exclusive jurisdiction of the courts of the State of South Australia.
